Zometa/Aredia Lawsuit
Case Status a/o July/ 2006

We have filed more than 100 cases against Novartis on behalf of individuals who have been given Aredia or Zometa and developed osteonecrosis of the jaw, also known as ONJ.

While most of our individual cases were filed several months ago, the process of getting them centralized was only accomplished on April 18, 2006, when the Judicial Panel ordered all Aredia and Zometa cases transferred to Nashville, Tennessee for pre-trial proceedings. As we have explained before, only pre-trial proceedings are being handled in Tennessee. If your case goes to trial, it is likely that such trial will take place in your home state.

The case has been assigned to Judge Todd A.Campbell. Working alongside Judge Campbell is Magistrate Judge Joe Brown. On June 29, 2006, we had our first conference with the Court in which we (and the lawyers for Novartis) spent 3 hours with the Magistrate discussing the management of the litigation and deadlines for certain events. At the conclusion of the conference, the Court ordered the attorneys for both sides to prepare an Order setting forth a proposed schedule for the litigation. That has been done.

The next substantive step in the litigation will be the production of documents by Novartis, which is scheduled to begin by the end of August 2006. Novartis, who has already told us they have 1.7 million documents to deliver to us, is in the process of converting the documents to electronic form so that we can review them by computer rather than by hand. Once this conversion has been done and the documents have been made available to us, we, along with the other attorneys who have filed ONJ cases, will begin our review of those materials.

We expect this will take several weeks, if not longer. In the meantime, we will be performing other work on the cases, such as meeting with experts in the medical profession, collecting medical records from you various doctors and continuing to meet with each of you in person to talk about your case.
